Agreement To Rules:

• By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Utah FAST as final and binding.

Eligibility:

• Participants are required to be lawful citizens of and live in the United States.
• Participants are not required to be a resident of Utah. However, all federal, state, and local laws are applicable in the participant’s state of residence.

Age Requirements:

• Participants must be at least 18 years old if the prize is a rifle or shotgun.
• Participants must be at least 21 years old if the prize is a pistol, frame, receiver, or NFA firearm including a silencer.
• Participants must not be restricted from purchasing, possessing, transferring, or owning a firearm as defined under federal, state, and local laws.

Valid Identification:

• The winner must possess a valid state-issued Driver’s License or Identification Card and provide photo identification including proof of age when claiming their prize.

Tickets:

• Tickets will be sold for $25.00 each. A maximum of 100 tickets will be sold.
• If you wish to enter both drawings you must purchase tickets for both EDC Packages.
• There is no limit to the number of tickets a participant may purchase.
• Tickets can be purchased in person or on our website.
• All entries must be made in the name of the individual purchasing the ticket(s).
• Transfer of ownership of a ticket is not permitted.
• By purchasing a ticket, you certify that this contribution is made from your own personal funds, not from an account maintained by another individual, and is not being reimbursed by another person or entity.
• Utah FAST is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected ticket purchases.
• Utah FAST reserves the right to cancel this raffle at any time, in which event its liability is limited to the refund of ticket prices to participants. Otherwise, all ticket sales are final and non-refundable.

Period:

• Tickets will remain available until all tickets have been sold. After which a single winner will be chosen randomly.

Utah Residents:

• Utah FAST will cover the background check fee, if applicable, only if the transfer is completed at our location.
• Utah FAST will cover the cost of shipping to another FFL dealer within Utah.
• The winner will be required to pay any associated transfer and/or background check fees required by the receiving FFL dealer.

Non-Resident Transfer:

• If the winner is not a Utah resident and currently lives in another state the participant must follow their state’s laws and must make arrangements with a local FFL dealer to receive the transfer.
• Utah FAST will cover the cost of shipping to another FFL dealer in the participant’s state of residence.
• The winner will be required to pay any associated transfer and/or background check fees required by the receiving FFL dealer.

Prize Value:

• Actual/appraised value may differ at the time of prize award.
• The specifics of the prize shall be solely determined by Utah FAST.
• The cost of tickets purchased is not tax deductible. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Please consult your tax advisor.
• No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the winner is permitted.
• If the winner lives in a state where any part of the prize is prohibited, including but not limited to any firearm, magazine capacity, or NFA restrictions, the prize will not be shipped containing any applicable prohibited item. See our Store Policies for example restrictions.

Odds Of Winning:

• The chance of winning is the “number of tickets purchased” divided by the number of tickets sold.
• Each ticket has a separate and equal chance of winning as prizes are being drawn.

Winner Selection And Notification:

• The winner for each drawing will be selected randomly using the website https://wheelofnames.com.
• The winner will be notified via the contact information provided.
• Utah FAST shall have no liability for a winner’s failure to receive notices due to the winner’s spam, junk e-mail, or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information.
• If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize will be forfeited and an alternate winner selected.
• The winner will also be announced on our Facebook, Instagram, and Twitter pages.

Compliance With State & Federal Law:

• The receipt by the winner of the prize offered is conditioned upon compliance with any and all federal and state laws and regulations.
• The winner will be required to complete a Firearm Transaction Record (ATF Form 4473) and pass a background check.
• If the background check is returned “denied” another winner will be chosen at random.
• ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT UTAH FAST’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER AND ALL PRIVILEGES AND RIGHTS AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted By You:

• By participating, you understand that Utah FAST, and anyone acting on behalf of Utah FAST, or its respective licensees, successors, and assigns will have the right, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Acts Of God:

• Utah FAST reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this event should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct. In such a case, Utah FAST may draw the winners from all eligible entries received prior to and/or after (if appropriate) the Act of God.

Integrity:

• These official rules may not be waived, modified, or supplemented except by Utah FAST.
• Utah FAST has the right, in its sole discretion, to maintain the integrity to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation may be a violation of criminal and civil laws, and should such an attempt be made, Utah FAST reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation Of Liability:

• By entering you agree to release and hold harmless Utah FAST and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, volunteers, officers, and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

Disputes:

• GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND UTAH, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating, the participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this event, shall be resolved individually, without resorting to any form of class action, exclusively before a court located in Utah having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than the participant’s actual out-of-pocket expenses (i.e., costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
